به علت شباهت های دو سیستم حقوقی ایران و مصر در موضوع تحقیق از یک سو و کامل بودن سیستم حقوقی مصر در بیان منظم موارد واقعی سقوط تعهدات از سوی دیگر ، بررسی تطبیقی سیستم حقوقی دو کشور درخصوص موضوع تحقیق را ضروری می ساخت، تا زاویه های مختلف ماده ۲۶۴ قانون مدنی روشن شود و تا حدود زیادی ، نواقص و ابهامات موجود در آن را آشکار گردد ، و قدم کوچکی در جهت جلب نظر قانونگذار برای اصلاح وتکمیل و نظم بخشی به ماده قانونی فوق ، برداشته شود تا مشکلات حقوقی و اداری جامعه کاهش یابد .بنابراین این سؤال پیش می آید که" سقوط تعهد بدون ایفای تعهد "در سیستم حقوقی ایران و سیستم حقوقی مصر چگونه توضیح داده شده است؟ و پیامدهای آن چیست؟ در این تحقیق ، اطلاعات مورد نیاز عمدتا از روش تحقیق کتابخانه ای و علاوه بر آن ، از مقالات حقوقی معتبر که در این باره نوشته شده اند ، استفاده شده است .نتیجه این که ماده قانونی فوق ، به علت عدم تفکیک بین اسباب سقوط تعهدات واسباب خاتمه تعهدات ، کارآیی چندانی ندارد و نادرست و ناقص است زیرا ، اولا مواردی که توسط این ماده قانونی ارائه شده است ، براساس نظریه وسیع سقوط تعهد) به معنای صحیح خاتمه تعهد (ناقص است .مثال اگر تبدیل تعهد سبب سقوط تعهد است ، چرا صفسخ نباشد؟ اگر انحلال قرارداد به دلیل اینکه به صورت غیرمستقیم سبب سقوط تعهد ، در این گروه قرار می گیرد ، چرا تلف مورد معامله و فوت یکی از دو طرف ، یکی از اسباب سقوط تعهد نباشد ؟ از طرف دیگر ، براساس تئوری تفسیر محدود ، سقوط تعهد) به معنای خاص آن (باید محدود به مواردی باشد که تعهد ایجاد شده به دلیل علت خاص قبل از اجرای آن از بین برود .در این فرض ، صابراء تنها نمونه آن باقی می ماند ، در حالی که نهادهای حقوقی دیگر که کارکرد مشابهی با صابراء دارند ، در ماده قانونی مذکور ذکر نشده اند ، مانند صمرور زمان زمان ، ص غیرممکن بودن اجرای قرارداد و
Due to the similarities between the two legal systems of Iran and Egypt on the one hand, and the completeness of the Egyptian legal system on a regular basis in real-life cases of collapse, on the other hand, a comparative study of the two countries' legal system on the subject of investigation was necessary. To clarify the various angles of Article 264 of the Civil Code and to a large extent reveal the deficiencies and ambiguities therein, and take a small step to bring the legislator's view of amending the said law to legal problems and Reduce administrative bureaucracy. So the question arises how the "collapse of non-commitment" is explained in the Iranian legal system and the Egyptian legal system. And what are the consequences? In this research, the required information is mainly used by the library research method and in addition to the valid legal articles written on it. The result is that the above statute is ineffective because of the lack of distinction between the Causes of collapse of commitments and the Causes of termination of the obligations because, first, the cases provided by this statute are based on the broad theory of the collapse of commitment (In its specific sense: Commitment termination) Inaccurate and incomplete. Example: If the conversion of the obligation causes the collapse of commitment, why not the cancellation? If the dissolution of the contract falls into this category because it indirectly causes the pledge to fall, why not one of the parties to the loss and the death of one of the plaintiffs is not a pledge? On the other hand, according to the theory of constrained interpretation, the collapse of the obligation (in its specific sense) must be limited to those cases where the obligation arising out of a specific cause before its execution is eliminated. In this assumption, "Ebra" remains the only example of it, while other legal entities that perform similar functions to "Ebra" are not mentioned in the legal provision, such as "lapse of time", "impossible to enforce the contract, and
