حق آزادی تجمعات به طور گسترده‌ای در سطح بین المللی، منطقه‌ای و ملی در اسناد مختلف حقوق بشری در زمره حقوق مدنی و سیاسی به رسمیت شناخته شده است .این آزادی افراد را قادر می‌سازد تا با یکدیگر تجمع نموده و به طور جمعی مصالح و منافع مشترکشان را بیان نموده یا ارتقاء بخشیده و از آنها دفاع نمایند .چنین تجمعی می‌تواند به منظور پی‌گیری یا دستیابی به هدفی مشترک اعم از مسایل و موضوعات سیاسی، مذهبی، اعتقادی، اقتصادی، شغلی، اجتماعی ورزشی، فرهنگی یا حرفه‌ای باشد .این آزادی در اعلامیه های متعدد حقوق بشری مورد تاکید قرار گرفته است .چنانچه ماده ‮‭۲۰‬ اعلامیه جهانی حقوق بشر آزادی اجتماعات را در کنار آزادی گروه ها مورد تاکید قرار داده و ماده ‮‭۲۱‬ میثاق بین المللی حقوق مدنی و سیاسی در این خصوص اعلام می دارد:ص حق تشکیل مجامع به رسمیت شناخته می شود .اعمال این حق تابع هیچگونه محدودیتی نمی تواند باشد جز آنچه بر طبق قانون مقرر شده و در یک جامعه ی دموکراتیک به مصلحت امنیت ملی یا ایمنی عمومی یا نظم عمومی یا برای حمایت از سلامت یا اخلاق عمومی یا حقوق و آزادی های دیگران ضرورت داشته باشد. در قانون اساسی کشورمان نیز ذیل اصل ‮‭۲۷‬ قانون اساسی این حق به رسمیت شناخته شده است و اعلام می دارد :ص‌تشکیل اجتماعات و راهپیمایی ها بدون حمل سلاح به شرط آنکه مخل به مبانی اسلام نباشد آزاد است .در این پایان نامه از یک طرف به بررسی ضوابط و شرایط اعمال این حق پرداخته شده است و از طرفی دیگر عواملی که می توانند مانع از اعمال آزادی تجمعات از سوی اشخاص وگروه ها گردد نیز مورد بررسی قرار گرفته است

In our constitution , under Article 27 of the constitution , this right is recognized and declared : " Public gatherings and marches unarmed provided they do not violate the principles of Islam is not free ." In this thesis we have investigated the conditions for the exercise of the right hand, then the other factors that can hinder the exercise of freedom of assembly of the persons have studied Freedom of assembly is widely internationally , regionally and nationally recognized in various human rights instruments classified as civil and political. This freedom enables people to gather together and collectively express their common interests or upgrade to forgive and to defend them . Such cumulative order to pursue or achieve a common goal , such as political issues , religion, economic, business , social, sporting , cultural or be a professional . This right of association and the many declarations of human rights has been underlined . Article 20 of the Universal Declaration of Human Rights, freedom of assembly, freedom of the side groups highlights and Article 21 of the International Covenant on Civil and Political Rights , which states : " the right of assembly is recognized . Can not be subject to any limitation on the exercise of this right other than those prescribed by law and in a democratic society in the interest of national security or public safety, public order, or the public or the rights and freedoms health or morals supporting be necessary other .
