مطالعه تطبیقی قواعد عمومی دفاع شکلی در حقوق ایران و عراق و مصر، که موضوع پژوهش حاضر است، یکی از مباحث مهم در قانون آیین دادرسی مدنی می‌باشد. چون‌که تکنیک هایی که طرفین دعوا در موقعیت دفاع از خود بدان متوسل می شوند ایجاد موانعی در راه رسیدگی دادگاه می‌گردد، که این موارد با عنوان دفاع شکلی در آئین دادرسی مدنی شناخته می شوند. در قانون ایران مواد ۸٤ تا ٩٢ ، در قانون عراق مواد ٧٣ تا ٨٢ و در قانون مصر مواد ١٠٨ تا ١١٧در مورد دفاع سخن می‌گوید، به اضافه دفاع‌های دیگر که در مواد پراکنده در قوانین مذکور آمده‌‌اند. و علیرغم اهمیت قواعد عمومی دفاع شکلی، اما جایگاه و نقش مهم بر آن داده نشده است. دفاع‌های شکلی در قانون‌های ایران و عراق و مصر به صورت تمثیلی آمده‌اند، یعنی دفاع های هستند که احکام آن در قانون ذکر نشده‌است، لذا احکام و قواعد کلی که بتواند آن را تنظیم کند، ضروری می باشد، در این پژوهش پنج تا قاعده عمومی بررسی شده است که (ذینفع دفاع شکلی، زمان طرح دفاع شکلی، کیفیت ارائه دفاع شکلی، آثار طرح دفاع شکلی، و تصمیم دادگاه در مورد دفاع شکلی) می‌باشند، که در قانون‌های کشورهای مزبور احکام آن حاوی اختلافات زیادی اند، که در این پایان نامه‌ به آن پرداخته می‌شود.

Abstract A comparative study of the general rules of formal defense in the laws of Iran, Iraq and Egypt, which is the subject of the present study, is one of the important issues in the Code of Judicial Procedure. Because the techniques used by litigants in self-defense situations create barriers to litigation, these are known as formal defense in civil procedure. Articles 84 to 92 in Iranian law, Articles 73 to 82 in Iraqi law, and Articles 108 to 117 in Egyptian law deal with defense. In addition to the other defenses contained in the scattered materials in the other laws. And despite the importance of the general rules of formal defense, it has not been given an important place and role. Formal defenses are allegorical in the laws of Iran, Iraq and Egypt, they are defenses whose provisions are not mentioned in the law, so the general rules and regulations that can regulate it are necessary. In this study, five general rules are examined. (Beneficiaries of formal defense, timing of formal defense, form of presentation of formal defense, effects of formal defense, and court decision on formal defense), whose provisions in the laws of these countries contain many differences, which in this dissertation It is addressed.
