اعمال حقوقی از مباحث اساسی و مهم حقوق خصوصی به شمار می رود.اهمیت این بحث به دلیل تنوع، کاربرد و وسعت آن و هم چنین به دلیل ارتباط مستقیمی که با نظام اقتصادی دارد، واضح و روشن است.جوهر واساس اعمال حقوقی را قصد و اراده بوجود آورنده آن تشکیل می دهد که در واقع محور اساسی و مولد تمامی اعمال حقوقی می باشد .یکی از بخش های مهم اعمال حقوقی بحث آثار آن است که در واقع هدف و مقصود طرفین اعمال حقوقی، دستیابی به آثار و نتایج آن می باشد.یکی از مباحث مهم در ارتباط با آثار اعمال حقوقی ، مبحث راجع به نقش اراده در جریان آثار اعمال حقوقی است.در اینجا از یک جهت به نقش اراده در ترتب یا عدم ترتب آثار اعمال حقوقی پرداخته شده و مشخص گردیده است که ترتب یا عدم ترتب آثار اعمال حقوقی تا چه حدی تحت حاکمیت اراده طرفین است و تا چه میزانی تحت نفوذ ضوابط حقوقی قرار دارد.از جهت دیگر نیز نقش اراده در زمان ترتب آثار اعمال حقوقی مورد بررسی قرار گرفته و در نهایت این نتیجه بدست آمده است که زمان ترتب آثار اعمال حقوقی جزء مقتضای ذات آن ها نیست و طرفین می توانند در بسیاری از موارد در زمان ترتب آثار اعمال حقوقی انحراف ایجاد نمایند.هم چنین به عمل حقوقی معلق به عنوان یکی از طرق ایجاد انحراف در زمان ترتب آثار اعمال حقوقی اشاره شده است

legal actions is an important issue in private law. the importance of this issue because of the diversity, application and its scope and also due to direct contact with the economic system. The essence of legal acts formed by creator intention that it is the basis of all legal actions. one of the most important parts of the legal actions is works that actually the purpose of the parties in legal actions, achieving to its implications. one of the most important issues related to the effects of legal acts is discussion about the role of the intention in the work of law enforcement. here the role of intention in a sequence or non- sequence works dealt with legal actions and has been shown in the sequence or non-priority works to what extent legal acts under the rule of the will of the parties and to what extent is influenced by legal norms. On the other hand, in this research examined also the role of intention in the time sequence of legal actions. The results indicate a time sequence of legal actions works is not their essence component and the parties can in many cases cause a deviation in the time sequence of law enforcement works. in this research also mentioned pending legal action is one of the ways that made a deviation in the time sequence of law enforcement works
