?A pledge is a contract whereby a debtor gives a property to the creditor as a security and also the property of debtor is as the security of claim. According to Article 794 of Civil Code:" The debtor may make changes in the pledge, or perform other proprietary rights on the pledge which are of advantage to it and which do not impinge on the rights of the creditor, without there being any right for the creditor to prevent such action; if the creditor prevents, the judge may give permission". On the one hand, given the above-mentioned article, it becomes clear that pledge contract decreases debtor's authority over possession of thing pledged, but doesn't not eliminate his proprietary right and debtor has proprietary right over object pledged. On the other hand, in above mentioned article, to what kind of proprietary rights is referred? Possession literally means to do something, to own or gain something, but in legal terms, it means a property which is in one's authority and he/she can make a decision about that property in relevant laws. Possession may be by condition or by owing like the possessions of guardian and attorney, transference or non-transference, advocated or non-advocated or it may be corrective and etc.In this study, on the one hand, an examination will be done around this issue: which one of these mentioned possessions impinge the rights of creditor and which of them don't impinge the rights of creditor and are valid? On the other hand, can the action of debtor to sell pledged property to the third party without the permission of creditor be considered among possessions that impinge the right of creditor
