استفاضه به معنای شایع بودن یک مطلب بین مردم است به نحوی که تعداد زیادی از مردم از آن خبر دهند و از گفته‌صی آنها علم و یا ظن قوی به مضمون خبر حاصل شود .این واژه، از اصطلاحات علم فقه و اصول فقه می‌صباشد که از آن به شیاع و تسامع نیز تعبیر می‌صشود .استفاضه یکی از راههای اثبات دعوا به شمار می‌صرود که در فقه امامیه و فقه مذاهب چهارگانه اهل سنت، جایگاه شناخته شده‌صای را به خود اختصاص داده است .ولی متأسفانه با وجود این، قانونگذار ایران در هیچ یک از مجاری مرتبط با ادله اثبات دعوا، نامی از آن به میان نیاورده است .در مورد ماهیت استفاضه، عبار ت های فقهاء مختلف است آنچه از عبارت‌صهای بعضی از فقها استفاده می شود اینکه، استفاضه یک دلیل مستقل از بینه می‌صباشد که موارد خاصی با آن ثابت می شود و از عبارت های بعضی از فقها استفاده می شود که نوعی شهادت است که درجه اعتبارش از شهادت اصلی کمتر است .از نگاه فقیهان اسلامی، امور قابل اثبات بوسیله استفاضه مواردی همچون نسب، وقف، نکاح و ...است که اگر استفاضه را دلیل و طریق اثبات آنها نیانگاریم در عمل اثبات این دسته از امور، دشوار و شاید غیر ممکن خواهد گشت .با توجه به این جایگاه ارزشمند استفاضه در فقه مذاهب خمسه، خ‍ قانونی موجود در قوانین موضوعه‌ص‍ ایران، قابل چشم‌صپوشی نیست به ویژه اینکه استفاضه، در حقوق موضوعه سودان، به صراحت مورد توجه بوده است تا بدانجا که در کشور سودان مواد ویژه‌صای برای آن در ضمن قانون اثبات)ماده ‮‭۲۹)‬و قانون احوال شخصیه ویژه مسلمانان)ماده ‮‭۱۰۷)‬در سه بند، اختصاص یافته است و از این رو، باید در حقوق موضوعه ایران نیز مطرح می‌صگردید
