قرارداد اختیار معامله و قرارداد آتی از جمله قراردادهای مالی مشتقه هستند که نه تنها در مراودات مالی و روزمره جامعه نقش ایفاء میث کنند، بلکه اکنون در بورس های مهم دنیا به عنوان ابزار مالی کارآمد، میان فعالان بورس کاربرد بسیار دارند.بند ۱۱ ماده ۱ قانون بازار اوراق بهادار جمهوری اسلامی ایران قرارداد اختیارمعامله و قراردادآتی را به عنوان ابزارهای مشتقه مالی معرفی می کند،اما درباره مفهوم و ماهیت آنها سخنی به میان نیاورده است.با توجه به مزایا و کارکردهای ابزارهای مالی نوین در کاهش و مدیریت ریسک و رونق بازارهای سرمایه،بررسی قرارداد اختیارمعامله و مقایسه آن با قراردادآتی که از مهم ترین آن محسوب می گردند و اینکه این قراردادها در بسیاری از بازارهای مالی کشورهای توسعه یافته،در جایگاه ابزاری کارآمد مطرح هستند،فقیهان و حقوقدانان اظهارنظر قابل توجهی درباره ماهیت آنها ارائه نکرده اند .تحقیق حاضر باتوجه به موضوع آن که کاملا جنبه کاربردی دارد و امروزه مرد نیاز بازار سرمایه در ایران است،پس از بیان و بررسی دیدگاههای مطرح در این خصوص که توسط برخی از فقها و حقوقدانان ارائه شده، به دنبال توجیه مناسبی از مبانی اعتبار قرارداد اختیار معامله و تبیین ماهیت فقهی و حقوقی آن و مقایسه آن با قراردادآتی در ایران است که این دو قرارداد از لحاظ فقهی و حقوقی قراردادهایی مستقل هستند

Option transaction and future contract, including derivative financial contracts are that not only play a role in the daily financial transactions of society, but now in the world's major stock exchanges as efficient financial instruments between the market activists are very useful. Article 1 Section 11 of the Securities Market Law in Islamic Republic of Iran presents option transaction and future contract as derivative financial instruments, but their concept and nature not mentioned. Considering the advantages and applications of new financial instruments to reduce and manage risk and capital markets development, evaluating option transaction contract and comparing it with future contract is the most important ones. These contracts are in many developed countries as a means of efficient financial markets. But jurists and lawyers have not substantial comment about their nature. The present study, today due to its fully functional aspect, is necessary for capital market in Iran. After describing and considering the expressed attitudes by some jurists and lawyers, followed a suitable explanation from the validity principles of option transaction contract and explain the nature of its jurisprudence and legal and compare it with futures contract in Iran we find that these two contract are independent contracts terms juridical and legal
