The referendum held in Spain by Catalonian community raised again the issue of self-determination and the need to define who has the right to secession according to international law. This event also raised debates all over the world about the juridical and political right of states or provinces to declare unilateral declaration of independence and secession. These events raised my interest to research more and understand the steps that the right to self-determination and secession has gone through until today. The dissolution of Yugoslavia leads to bloody wars and the loss of many lives, which ended with creation of many new states. The last one, even though it was the first one to raise the voice against the repression and violence of the human rights from the state authorities, who declare its independence is Kosovo which marks a unique case. This thesis aims to study the first case when an ethnic group who was facing human right violations has been putted under the international protection and has gone through a process of earning the sovereignty.
