The protection of the right to worship or assemble in connection with a religion or belief and to establish and maintain places of worship in Turkey serves as a good illustration of the nature of de jure and de facto restrictions in contrast to what appears to be a general recognition of the right to freedom to worship. The protection of the right to establish and maintain places of worship in the Turkish legal system appears to be restricted in three key areas, namely: (i) planning regulations; (ii) permission of public authority; and (iii) legal personality. Turkey must take necessary measures to bring its legislation and practice in line with international human rights obligations.
