This research is specifically concerned with the way in which legal situations are presented in two works of Voltaire: Candide and The Huron. The reason of choosing a French author of 18th century is that this period is indispensable in the study of law and literature because of the desire of reform in France. In this thesis, after elaborating briefly the legal thoughts of Voltaire, two of his important works are going to be analyzed with a juridical point of view. Voltaire defines frugally his legal thoughts using the fictional situations. He elaborates a lot of legal issues of his society in these two works and tries to show them ridiculous. Generally, a high value is placed on the independent view from which Voltaire was able to see the law of his society. He was always against racism and his most famous remark on slavery is found in Candide, where the hero is horrified to learn "at what price we eat sugar in Europe". The most important effect of Voltaire was on French criminal law. He argued that punishment must only result from violations of civil law, not of religious edict, and the crime must be distinguished from sin. In Candide, he condemns punishment for violations of religious ceremony or dogma. In this work, as well as in the Huron, he denounces religious intolerance, arbitrary power of the regime and the hypocrisies of the unjust society. In this research, we want to understand how an enlightenment writer sees the judicial system of his society and how he tries to change the unjust system of his society.
