ظهور پدیده‌صهای جدید در جوامع بشری علاوه بر ایجاد آسایش و آرامش برای عموم مردم نیازمند هنجارهای خاصی نیز هستند تا به شکلی دو جانبه برآورندة خواستهای مصرف کنندگان و همچنین حامی نظم عمومی و منافع تولید کنندگان آن باشند .از جمله خدماتی که اغلب سوء استفاده‌صکنندگان از آن با آسودگی خاطر بیشتری به اقدامات سودجویانة خود در قبال آنها می‌صپردازند، خدمات عمومی هستند .لذا لزوم حمایتهای کیفری و اعمال ساز و کارهای غیر کیفری در جهت پیشگیری از آنها به شکل جدی‌صتری احساس می‌صشود .در بیان نمونه‌صهایی از این خدمات عمومی می‌صتوان به آب، برق، گاز، تلفن و شبکه فاضلاب اشاره کرد که در قوانین کیفری ایران تا قبل از سال ۱۳۹۶ به شکلی پراکنده و عموما ناقص به آنها پرداخته شده بود .لذا وجود قانونی منسجم که دربرگیرندة حمایتی کامل‌صتر از این خدمات باشد احساس می‌صشد که این مهم به موجب ص قانون مجازات استفاده‌صکنندگان غیر مجاز از آب، برق، تلفن، فاضلاب و گاز مصوب ۱۳۹۶ تا حدود زیادی تامین شد .در این تحقیق سعی شده است تا ماهیت حقوقی جرم استفاده غیرمجاز از آب، برق، تلفن، فاضلاب و گاز، آنگونه که در قانون مذکور به آن پرداخته شده است، مورد بررسی قرار گیرد و به نواقص و محاسن این قانون در زمینه‌صهای مختلف حقوقی و جرم‌صشناختی به فراخور مطالب اشاره گردد .با تحقیق پیرامون قانون مذکور مشخص گردید، قانونگذار جرم استفاده غیرمجاز از خدمات عمومی را ذیل سه مصداق استفاده از خدمات عمومی بدون داشتن حق انشعاب ، استفاده‌ی غیر مجاز با داشتن حق انشعاب و دستکاری مخل در وسایل اندازه‌گیری گنجانده است و مواد یک و دو قانون به این مصادیق اختصاص داده شده است .در بیان خصوصیات این جرم می‌توان به مقید به نتیجه بودن و همچنین تحقق آن از طریق مثبت اشاره کرد در بخش جرم‌شناسی نیز در راستای مبارزه غیرقهرآمیز با جرم مذکور، علل و عوامل جرم‌شناختی موثر در ارتکاب جرم مورد بحث ، مورد اشاره قرار گرفته است و راهکارهای پیشگیری وضعی و اجتماعی از این جرم ارائه گردیده است.علل و عوامل مؤثر در ارتکاب جرم مورد بحث، ذیل دو بخش عوامل اقتصادی- اجتماعی)فقر و نابرابری درآمدی، تورم، بیکاری، حاشیه‌نشینی، بی‌سوادی و فقر فرهنگی (وعوامل وضعی)عدم حجمیت و قطعیت تهدید کیفری، عدم انجام وظایف قانونی شرکت‌ها و سازمان‌های ذیربط، فقدان ضابطین خاص، عوامل بوم‌شناختی و محیطی، آسیب‌پذیری آماج جرم (مورد بررسی قرار گرفته است و به تأسی از آن، بخش پیشگیری از جرم مذکور نیز، ذیل دو بخش راهکارهای پیشگیری اجتماعی)تلاش در جهت رفع فقر و تأمین حداقل نیازهای افراد جامعه، ارتقای سطح آگاهی و فرهنگ آحاد جامعه، افزایش هماهنگی بین نهادهای مختلف دخیل در امر ساخت وساز و تلاش در حل مشکلات حاشینه‌نشینان در زمینه دسترسی به آب، برق، تلفن، فاضلاب، و گاز (و راهکارهای پیشگیری وضعی)افزایش زحمات و تلاش‌های ارتکاب جرم و دسترسی به اهداف، افزایش خطرات ارتکاب جرم مانند شناسایی و دستگیری مرتکبین، کاهش دستاوردها و سودهای حاصله از جرم، حذف معاذیر تحریک کننده به ارتکاب جرم (مورد بررسی قرار گرفته است
The occurrence of new phenomena in human societies, in addition to providing comfort and tranquility for the general public, requires specific norms that mutually satisfies the demands of the consumers and also protect the public order and the products interests. One of the services that most of abusers take advantage of it, is public services. Therefore, there is serious need for criminal supports and application of non-criminal mechanisms to prevent them. Examples of public services are water, electricity, gas, phone and sewerage system which were mentioned incompletely in the Iranians criminal law prior to year 2017. Hence, there was a need for a coherent law which includes a full support of these services. This important issue was resolved by penal code of unauthorized use of water, electricity, phone, sewerage and gas(2017). In this research, the legal nature of unauthorized use of water, electricity, phone, sewerage and gas was investigated based on the aforementioned law, and defects and merits of the Law are addressed in different contexts (fields) of non-chaotic struggle with the crime . the most relevant causes and sociological factors and an effective situation in committing the crime as well as providing social prevention approaches for the crime was discussed. By studying this law, it was determined that the legislator has exemplified the crime of unauthorized use of public services in three categories: use of public services without legal subscription, unauthorized use of public services despite having legal subscription, and manipulation of the meter. Parts 1 and 2 of this law are assigned to these cases. Specifications of this crime in all three examples are: being result oriented and realization through positive action. In addition, in criminology, criminological factors in committing the crime are determined, and social and situational preventative approaches are provided. The pivotal factors in committing the abovementioned crime is investigated in two parts: 1) socioeconomic factors (poverty and inequality of income, inflation, unemployment, living in suburbs, illiteracy, cultural poverty), 2) situational factors (lack of certainty of criminal threat, failure in fulfillment of legal duties of the related companies and organizations, lack of specific advocate, ecological and environmental factors, and crime target vulnerability). Crime prevention is also investigated in to parts of social preventative approaches (eliminating poverty and providing the basic needs of community members, raising the level of awareness and community culture, increasing coordination between various organizations involved in construction, and solving the problems of marginalized communities to access water, electricity, phone, sewerage and gas) and situational preventative approaches (increasing perceived efforts, increasing perceived risks, reducing the anticipated rewards, removing excuses)
